Abstract

The use of Artificial Intelligence (AI) in the legal system in Indonesia has become a controversial topic and has raised pros and cons from society. On the one hand, proponents of using AI in law highlight the potential of this technology to improve the efficiency, accuracy and accessibility of the justice system. AI can process big data quickly and identify patterns that are undetectable by humans, enabling law enforcement to take more effective actions to prevent and deal with crime. However, the analysis also found various cons related to the use of AI in law. Some of the issues that arise include concerns about the transparency and accountability of AI decisions, data privacy issues, and the validity and reliability of the algorithms used. This study uses normative juridical analysis to investigate the pros and cons of using and determining the legal status of AI in Indonesian positive law. The research method uses a qualitative approach with normative juridical analysis to explore relevant legal data, including laws and policies related to the use of AI in the legal system in Indonesia. This research also includes a literature study and an analysis of court decisions related to AI. The results of the research show that the establishment of AI's legal status is a serious concern. Determining AI's legal status as a legal entity that is responsible and accountable for its actions still requires more detailed clarification and regulation. This article recommends the need for the development of clear and balanced regulations governing the use of AI in Indonesian law. The regulation must pay attention to aspects of transparency, accountability and data privacy to overcome counter-concerns related to the use of AI technology in the legal system.
